Terms and Conditions

HappiNest Home Services is a family-owned, fully insured home services business in the Seacoast Area.

HappiNest Home Services LLC – Terms & Conditions

HappiNest Home Services LLC (“Contractor”) provides residential home improvement and property services as outlined in written estimates, proposals, or contracts.

Scope of Work

All work is limited to the scope described in the written agreement. Any additional work or changes requested by the customer, or required due to unforeseen conditions, will require a written change order approved prior to proceeding.

Unforeseen Conditions

Contractor is not responsible for hidden or pre-existing conditions, including but not limited to structural issues, water damage, mold, or substandard prior work. Any such conditions discovered may require additional work and cost.

Payment Terms

Payment terms are defined in each project agreement. Contractor reserves the right to:

  • Require deposits prior to scheduling

  • Invoice progress payments

  • Suspend or stop work for non-payment

Late payments may be subject to additional fees where permitted by law.

Right to Stop Work

Contractor reserves the right to suspend work due to non-payment, unsafe conditions, lack of site access, or material delays beyond Contractor’s control.

Scheduling & Delays

Project timelines are estimates only and may be affected by material availability, weather, subcontractor scheduling, or unforeseen site conditions. Contractor is not liable for delays outside of its control.

Permits & Compliance

Where required, permits will be obtained by the appropriate licensed trade or as agreed. Customer agrees to cooperate with all inspection and permitting requirements.

Subcontractors

Contractor may utilize subcontractors to complete portions of the work. All subcontractors will be appropriately licensed where required.

Warranty

Contractor warrants workmanship for a limited period as defined in the project agreement. This warranty does not cover:

  • Normal wear and tear

  • Pre-existing conditions

  • Owner-supplied materials

  • Damage caused by others or environmental conditions

Limitation of Liability

To the fullest extent permitted by law, Contractor’s liability is limited to the amount paid for the services provided. Contractor shall not be liable for indirect, incidental, or consequential damages.

Indemnification

Customer agrees to indemnify and hold Contractor harmless from any claims, damages, or liabilities arising from conditions beyond Contractor’s control or from customer-provided materials or directions.

Site Conditions

Customer is responsible for providing safe and reasonable access to work areas and securing valuables and personal property.

Dispute Resolution

Any disputes shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes may be subject to mediation or legal action in the appropriate jurisdiction.

Entire Agreement

These Terms, along with any written estimate or contract, constitute the entire agreement between the parties
